Judge declares Obamacare Unconstitutional

The end of January saw a great breakthrough for freedom, the Constitution and your health. A federal judge declared Obamacare completely unconstitutional. In this court case, 27 states supported repealing Obamacare.

The battle for health freedom has two fronts:

  1. The court—that Obamacare is unconstitutional
  2. The U.S. Senate—to repeal it like the House did

The good news is U.S. District Judge Roger Vinson struck down the entire healthcare law.

Judge Vinson said the individual mandate—and everything else—are violations of our constitutional rights…

The higher taxes and premiums…the pork and waste…the abortion and rationing…all were declared unconstitutional.

In fact, the judge used President Obama’s words from the 2008 election campaign against him:

“I note that in 2008, then-Senator Obama supported a healthcare reform proposal that did not include an individual mandate because he was, at that time, strongly opposed to the idea, stating that, ‘If a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house’.”

Judge Vinson ruled, “Because the individual mandate is unconstitutional and not serviceable, the entire Act must be declared void.”

Then, there is the upcoming Senate drama and Senator DeMint’s bill to repeal Obamacare.

And just in time.

This year, some of the Obamacare provisions are creeping into law. The negative effects on healthcare are beginning to appear.

Hundreds of new physician-owned hospitals have stopped construction or have given up plans because of Section 6001 of the 1,990-page bill.

This limits competition, driving up costs for patients. It eliminates choices, which hurts patients, and quells doctors with new medical innovations…

  • Individuals and small-group insurances are being strangled by the new law—making it impossible to serve the consumer. The plans are disappearing, being forced out of existence. There will be less competition in the market and rates will be rising if Obamacare moves forward.
  • Large group insurances are raising their premiums as well to comply with the rules, regulations and mandates.
  • One of the greatest health innovations is the Heath Savings Account (HSA). But under the new law, HSAs cannot be used for over-the-counter drugs. Patients must get a doctor’s appointment and obtain prescription drugs at a pharmacy, raising the cost and wasting time.
  • Many taxes on businesses and individuals to support Obamacare are kicking in this year, reducing your income.
  • A $2.5 billion excise tax on pharmaceutical companies for example, will only be passed on in the form of higher drug prices.

200 economists who called for repeal of Obamacare say, “We believe [Obamacare] is a threat to U.S. businesses and will place a crushing debt burden on future generations of Americans.”

More than 65% of doctors fear healthcare will deteriorate under Obamacare. Why? Well, just look at the poor state of socialized medicine in Europe and Canada.

Breast cancer survival in the U.S. is 83.9% versus 69.7% in England. And prostate cancer survival is 91.9% versus 51.19%. This is because of bureaucrats, government control and waiting lists under socialized medicine.

With Obamacare, 40% of doctors are saying they will quit in the next 10 years, and 60.9% will retract their practices.

This is why the judge’s decision is so crucial a victory for freedom-loving America.
