The judges are the key to the outcome.
Having evaluated and researched judges for over 20 years with judgevoterguide.com, I know a judge’s judicial philosophy is more impactful than their training, experience, endorsements, or who appointed them.
A judge can be a strict constructionist who follows the Constitution and the law. Or they can be a judicial activist who bases their decisions on their own political ideology… they legislate from the bench and make law rather than follow it.
For example, the Trump Manhattan judge was a partisan, biased judicial activist (see my article: Not Surprised: How Trump Was Targeted by Ideologically Driven Government to Crush Him – And Likely Jail Him).
The type of judge you have is critical to the outcome.
Here are the two court cases and judges:
1) The tax trial
The tax trial will be held in California in September. Marc Scarsi, appointed by former President Donald Trump, will be its judge.
Like Trump’s other judicial appointees, he appears to be a strict judicial constructionist.
He won’t rule based on liking or not liking Hunter Biden.
He won’t rule based on his feelings and emotions or his own political ideology.
He will do what’s fair, even if it’s contrary to what he would emotionally like to see happen.
In the tax trial, Biden’s attorney, Abbe Lowell, asked to dismiss the case and requested delays multiple times.
Judge Scarsi has had enough of the defense trying to delay the court case.
Hunter Biden pleaded not guilty to nine felony and misdemeanor tax offenses. The charges against him included not paying $1.4 million in taxes and filing false returns from 2016 to 2019.
The charges were filed by Special Counsel David Wise.
Hunter could face up to 17 years in prison if convicted.
2) The gun trial
The other court case is the criminal gun possession case, and the jury has found Hunter Biden guilty. Now, the sentencing from the judge comes next.
Special Counsel David Weiss charged Hunter Biden with making false statements on a federal form when he purchased a revolver in 2018, which is against the law. Hunter lied about his drug use, claiming he was not on drugs when he purchased the gun.
This case is being held in Delaware, and the judge is Maryellen Noreika, another Trump appointee and a strict constructionist.
U.S. District Judge Maryellen Noreika oversaw the original plea hearing in which Hunter was going to plead guilty to misdemeanor tax offenses; prosecutors recommended two years of probation. There was also a “diversion agreement” that would have allowed Hunter to escape prosecution on a felony gun charge as long he stayed out of trouble for two years.
However, Judge Noreika rejected the plea deal upon reviewing it. A few weeks later, Attorney General Merrick Garland named David Weiss Special Counsel.
Like the other judge, she has denied the defense’s requests to delay the trial.
Hunter’s attorney has appealed to other courts but hasn’t succeeded.
It took three hours over two days for the jury to find Hunter Biden guilty on felony gun charges, making Hunter the first child of a sitting president to be convicted of a crime.
Judge Noreika didn’t set a sentencing date, noting that it could occur roughly four months after conviction.
Biden could face up to 25 years in prison, but it’s unlikely that Hunter will face any real time in prison.
It’s more likely that President Biden will give Hunter clemency, but he says he won’t.
These two cases are minor cases that show the Special Counsel is doing its job and that the DOJ isn’t biased, only going after Trump and his associates.
But the DOJ dragged its feet on Hunter’s more serious crimes to let the statute of limitations run out.
